Who can buy agricultural land in Gujarat?

This page will disqualify most people who read it. That is deliberate. It is better to know now than after a site visit and a lawyer's fee.

The short answer

ELIGIBLE

An individual holding a valid Gujarat agriculturist certificate

From any district in Gujarat. NRIs who hold Gujarat agriculturist status are included.

NOT ELIGIBLE

Everyone else

Buyers without agriculturist status. Companies, LLPs, partnership firms and Hindu Undivided Families. Buyers intending to fund the land through a loan. Buyers intending to rent, run a homestay, or commercially lease the property.

Why the restriction exists

Tranquil Farms is agricultural land. It has not been converted to non-agricultural use, and it is not a RERA-registered residential project. Gujarat's land laws restrict who may hold agricultural land, and those restrictions pass through to every plot on this estate. This is not a policy Radhe Developers has chosen. It is the legal character of the asset.

But look at what the same restriction does for the nineteen owners. It means every neighbour cleared the same legal bar you did, it means the surrounding land cannot be bought up and built over by anyone with capital, and it means the estate's character is protected by law rather than by a society's goodwill. Exclusivity here is not a marketing word. It is a statute.

What an agriculturist certificate is

An agriculturist certificate, commonly called a khedut kharai certificate, is issued by the revenue authorities and evidences that you hold agricultural land and are recognised as an agriculturist in Gujarat. It is typically supported by your 7/12 utara (the record of rights for a land parcel) and your 8-A khatavahi (the account showing all land held in your name in a village).

If you already own agricultural land anywhere in Gujarat, you very likely hold, or can readily obtain, this certificate. If you do not, obtaining agriculturist status is not a formality that can be arranged for a purchase.

On financing

The land component at Tranquil Farms is not loanable. Banks and NBFCs do not generally lend against agricultural land. The construction component may be financed subject to your bank's own terms. In practice this means a buyer needs to fund approximately ₹9.75 crore of land and development cost without institutional debt.

Radhe Developers does not arrange financing and has no bank tie-ups for this estate.

On how the property may be used

The plot and villa are for the owner's own use. Renting the villa, operating it as a homestay, and commercially leasing it are all prohibited. There is no rental yield associated with this purchase and it should not be evaluated as an income-producing asset.

There is no lock-in period before resale. Resale must be to another buyer who is themselves eligible to hold agricultural land in Gujarat, which is a materially smaller pool of buyers than an ordinary property resale.

Who can buy agricultural land in Gujarat?

Under Gujarat law, agricultural land may generally be purchased only by a person who already holds agriculturist status, evidenced by an agriculturist certificate, often called a khedut kharai certificate. For Tranquil Farms specifically, the buyer must be an individual holding a valid Gujarat agriculturist certificate from any district in the state.

Can a non-agriculturist buy agricultural land in Gujarat?

No. A buyer without agriculturist status cannot purchase agricultural land in Gujarat, and cannot purchase a plot at Tranquil Farms. This applies regardless of whether the buyer is a Gujarat resident. There is no waiver available at this estate.

Can an HUF, company, LLP or partnership firm buy a plot at Tranquil Farms?

No. Plots at Tranquil Farms are sold to individuals only. Hindu Undivided Families, companies, limited liability partnerships and partnership firms cannot hold a plot here, even where one or more members individually hold agriculturist status.

Can an NRI buy agricultural land in Gujarat?

Generally, a Non-Resident Indian cannot acquire fresh agricultural land in India. However, an NRI who already holds Gujarat agriculturist status may be eligible. NRIs with Gujarat agriculturist status are eligible to buy at Tranquil Farms, subject to their own legal and FEMA verification.

Does the agriculturist certificate have to be from a specific district?

No. An agriculturist certificate from any district in Gujarat is acceptable for Tranquil Farms.

Does Radhe Developers help verify my eligibility?

No. Radhe Developers does not undertake eligibility verification on a buyer’s behalf. Buyers should confirm their status with their own legal advisor before proceeding.
